The RPG game will send the data to the faraway server and the server sends a signal back to the game. The round trip time is called lag or latency. If it is too great then the game will be far too laggy.

99.9999% sure you won't have legal troubles as long as you don't sell the game. Its called "Fair Use".

RM actually might be right, this could cause a lawsuit. However, the lawsuit could be avoided should DanteandVergil get permission from whoever owns Spyro (the company keeps switching around, so I'm just going with that statement, lol) to create an MMORPG. Plus, the company could see it as some sort of endorsement, due to the fact that people who've never heard of Spyro, if they see this forum and the game, it might get them hooked to Spyro, and then the company makes more sales from the new fans. It's basic business sense.
